Overview of Terms and Conditions
Sentiens (referred to herein as “we” “us” “our”) sells yoga and fitness gear at www.sentiens.co.za (referred to herein as “our website”). The Terms and Conditions depicted in this document (referred to herein as “these terms and conditions”) govern the legal relationship between Sentiens and our customers (referred to here in as “you”).
By viewing and / or using our website, you agree to be bound by these Terms and Conditions. We reserve the right to amend our Terms and Conditions at any time. Any changes to our Terms and Conditions are effective immediate.
Online store terms
By using our site, you agree that you are at least the age of majority or that you are the age of majority and you have given us your consent to allow any of your minor dependents to use this site.
You may not use any of our products for any illegal or unauthorised purpose. Neither may you use our website in any way that may violate any laws in your country of jurisdiction (including but not limited to copyright laws).
You may not transmit any worms or viruses or any code of a destructive nature.
This website is hosted and operated from the Republic of South Africa and these Terms and Conditions are governed by the laws of the Republic of South Africa. You consent to the jurisdiction of the Magistrate Courts in respect of all proceedings arising out of these Terms and Conditions. The parties may, in any event, agree to the jurisdiction of any other court.
We own and are the licensees of all content depicted on this website. This includes, but is not limited to all text, images, videos, logos, trademarks and designs. You may not copy, publish, distribute or use any of this content in any way for any purpose without our prior written consent.
The private information we require from you in order to process your order include your personal information, delivery address and telephone numbers. These details will remain in strict confidence with us at all times. We will not sell or make your information known to any third parties. Only the information necessary for shipping will be provided to the courier service we use to deliver your product.
We cannot be held responsible for any security breaches on your personal device, and the consequences of such breaches, which may result from a lack of adequate virus protection software or spyware.
The products for sale on our website are intended for use within your personal capacity only. We prohibit the purchase of any products for commercial resale purposes, without our prior written consent. We may limit your order to normal household quantities of 5 units per item, should the need arise.
You may not use our products for any illegal and / or unauthorised purpose.
We take all reasonable care to ensure that all details, descriptions and prices of products depicted on our website are accurate, and we rely on information from our suppliers to do so. It is possible for our website to contain certain errors, and we reserve the right to correct these errors at any stage. Should our error impact an order placed with us, we reserve the right to refuse or cancel this order in line with our order policy depicted below.
Please note that the colours depicted in our designs may look slightly different across various computer monitors and screens. Receiving a mat that differs slightly in colour to what was depicted upon your screen when you placed your order does not warrant the good as faulty.
Product prices, currency and VAT
All product prices on our website are depicted in South African Rand and include VAT. All payments are processed in South African Rand.
Unless otherwise stated, shipping is charged in addition to the price of the product. A breakdown of product price, VAT and shipping charges appears on our checkout page. VAT is charged at 14%.
We may change the price of any of our products at any stage without prior notice. The new product pricing comes into effect immediately.
Payments may be made via Visa or Mastercard credit cards or by electronic bank transfers into our bank account. All details are provided upon checkout.
All credit card transactions take place via Payfast; an internationally approved payment gateway. Please note that you do not have to have an existing Payfast account to pay via credit card - you can simply make use of the PayFast platform on a once off basis.
We reserve the right to refuse any order. This could, for example, result from one of the following: the product being unavailable from stock, or identification of an error within the product information, such as pricing or promotion.
During the order process, and prior to shipment, you will receive an "order confirmation" email from us. This email does not guarantee that your selected product or products are available in stock and neither does it serve as a legally binding obligation to fulfill your order. Your order represents an offer to purchase, which we only accept when we dispatch your goods for shipment. We signify our acceptance of your offer through an email entitled “shipment concluded” (second email).
We reserve the right to cancel your order anytime between receipt of order and shipment, for any reason, whether or not payment has been made. When payment has been made, you qualify for a full refund. In the unlikely event that your chosen product is not in stock, we will contact you as soon as possible. In this case, you may choose to receive a full refund or for store credit to be allocated to your account.
Cancelling your order
You may cancel your order any time prior to shipment, whether or not payment has been made. In the cases where payment has been made, you will be refunded after a reduction of 10% for administration costs (upon total order cost).
If you have elected to pay via electronic funds transfer (EFT) we reserve the right to cancel your order 24 hours after you have placed it should you not provide adequate proof of payment.
We ship across South Africa and process international wholesale orders upon request. We ship during normal working hours Monday to Friday: not on Saturdays and public holidays.
We will supply all goods to our delivery company in good order. The onus rests upon them to ensure the goods arrive at your chosen delivery address in the same good order.
Delivery costs and times vary and depend upon weight and final shipping destination. Unless otherwise specified, your unique shipping cost shall be depicted upon checkout prior to payment and order processing.
We can only ship to a street address and not to a PO Box number. Should no-one be present at the delivery address to sign receipt of delivery (third attempt) your goods will be returned to the shipping agent’s office, and it is your responsibility to collect them. We cannot be held liable for an incorrect shipping address entered into our system. Once an order is shipped and the “sale concluded” the order is in the hands of courier service. Unfortunately, we cannot be held responsible for delays in delivery times caused by delays on the side of the courier.
In event that a non-standard surcharge applies to your order we reserve the right to add this cost onto your final quotation. This includes, but is not limited to: after hour’s shipments, deliveries to high crime areas, farms, or game reserves, and special delivery requests. Insurance quotes for wholesale orders are also included in this category.
In the unlikely event where your delivery may result in unacceptably high freight charges to us, we reserve right to cancel order prior to shipment. Our standard cancellation policy depicted above applies.
Returns and exchanges
In accordance with our returns policy depicted on our site, you may return a product and qualify for a full refund based upon the following 5 points:
You make contact with us within 3 days of receiving your product
Product is not damaged and shows no sign of usage
Product is in original packaging
Shipping and handling charges are not refundable; including return shipment (unless return is as a result of our error)
Gift cards and sale items are non-refundable
We require full banking details in order to process the refund (not applicable to Payfast purchases) and we will do so within 7 days of the goods reaching our door. Please note that any product exchanges are treated as a new order and are thus subject to standard delivery times and costs.
If you receive a damaged / incorrect product from us, you qualify for a full refund, or product replacement at our expense. Your replacement choice is subject to our stock availability. Kindly note that goods are only classified as damaged if they are received damaged. Items that are damaged during opening and from wear and usage are not considered faulty.
The use of any product bought from our website and the use of the website itself is at your own risk. We shall not be held liable for any loss or damage (including but not limited to indirect or consequential losses) incurred through the use of, or the inability to access or use, the products depicted on our website or the website itself.
We take responsibility for all aspects relating to your transaction. This includes the sale of goods depicted on the website, customer service and support, dispute resolution, and the delivery of goods to our courier service of choice.
By using our website or communicating with us through electronic means (such as email) you consent and acknowledge that any and all communication we provide to you shall satisfy the legal requirement that such communication should be in writing.
